1. Introduction

These Terms and Conditions ("Terms") govern all drafting services provided by SCH CAD Drafting Services ("we", "us", "our") to the client ("you", "your"). By engaging our services, approving a quote, submitting documentation, or communicating with us regarding a project, you agree to be bound by these Terms.

These Terms apply to all drawings, documentation, revisions, communications, deliverables, and professional services provided by SCH CAD Drafting Services. These Terms are designed to ensure clarity, fairness, and legal protection for both parties and are consistent with the requirements of Australian law, including the Australian Consumer Law (ACL).

2. Scope of Services

SCH CAD Drafting Services provides drafting and documentation services, including but not limited to:

  • Technical drawings
  • Architectural drafting
  • Plan updates and revisions
  • Conversion of sketches or concepts into technical drafting formats
  • Preparation of digital drafting files
  • Documentation support for design and planning processes

We do not provide engineering certification, structural verification, compliance approval, surveying, or construction supervision. Our responsibility is strictly limited to the drafting work and documentation we produce.

3. Quotes, Pricing, and Hour-Based Billing

3.1 Quote Preparation

All quotes are prepared based on an estimated number of hours required to complete the project. This estimate is determined through discussions with the client, including:

  • Kick-off meetings
  • Phone calls
  • Email communications
  • Review of provided documentation and project requirements

3.2 Approval Requirement

We do not commence any work until the client formally approves the quote in writing (email approval is acceptable).

3.3 Time Tracking

Once the quote is approved:

  • We begin work and track the actual hours spent on the project.
  • Time tracking is performed accurately and transparently.
  • A breakdown of hours can be provided upon request at project completion.

3.4 Final Invoice

The final invoice is calculated as follows:

  • If the actual hours worked are equal to or greater than the estimated hours in the quote, the final invoice will be the full quoted amount.
  • If the actual hours worked are less than the estimated hours, the final invoice will be lower than the quoted amount.
  • The final invoice will never exceed the original quoted amount.
  • No additional charges will be applied without prior written agreement.

3.5 Scope Changes

If the client requests changes, additions, or modifications that alter the project scope:

  • Additional hours may be required.
  • We will notify the client before continuing.
  • A revised quote or variation may be issued if necessary.

4. Client Responsibilities

To ensure accurate and timely completion of drafting work, the client agrees to:

  • Provide complete, accurate, and up-to-date documentation
  • Supply all required measurements, references, and instructions
  • Respond promptly to drafts, questions, and clarifications
  • Review all drawings carefully before approval
  • Notify us promptly of any errors or required changes

We are not responsible for delays caused by missing information, unclear instructions, or late responses.

5. Site Measurements — Client Responsibility

Critical Disclaimer: SCH CAD Drafting Services is NOT responsible for site measurements.

The client acknowledges and agrees that:

  • All site measurements must be taken, verified, and supplied by the client or a qualified third party engaged by the client.
  • SCH CAD Drafting Services does not attend site visits, conduct physical measurements, or verify dimensions.
  • We rely entirely on the measurements and information provided by the client.
  • We are not liable for errors, discrepancies, or inaccuracies resulting from incorrect, incomplete, or outdated site measurements.
  • Any required corrections due to inaccurate measurements will be billed as additional work.

Our responsibility is strictly limited to producing drawings based on the information supplied. The accuracy of site data is the sole responsibility of the client.

6. Delivery of Work

All drafting work is delivered digitally unless otherwise agreed. Delivery timelines depend on:

  • Project complexity
  • Client responsiveness
  • Workload and scheduling
  • Availability of required documentation

We make reasonable efforts to meet agreed timelines but do not guarantee specific delivery dates unless explicitly stated in writing.

7. Accuracy, Use, and Limitations of Drawings

SCH CAD Drafting Services produces drawings with professional care and attention. However, the client acknowledges and agrees that:

  • Drafting drawings are not engineering certifications.
  • Drafting drawings do not guarantee compliance with building codes, council requirements, or construction standards.
  • The client is responsible for obtaining all necessary approvals, certifications, and engineering assessments.
  • We are not liable for construction outcomes, structural issues, or decisions made by builders, contractors, or third parties.
  • Drawings must not be altered, modified, or reused for other projects without written permission.

8. Limitation of Liability

To the fullest extent permitted under Australian law:

  • SCH CAD Drafting Services is not liable for indirect, incidental, consequential, or special damages.
  • We are not responsible for project delays, construction issues, or financial losses arising from the use of our drawings.
  • Our total liability is strictly limited to the amount paid for the drafting services provided.
  • We do not accept liability for errors resulting from inaccurate or incomplete information supplied by the client.
  • We are not responsible for decisions made by third parties, including builders, engineers, certifiers, or council authorities.

9. Refund Policy (Strict and Non-Negotiable)

Drafting services are charged based on actual hours worked, and all work is reviewed and approved by the client throughout the drafting process.

Strong Legal Disclaimer — No Refunds Under Any Circumstances

By engaging SCH CAD Drafting Services, the client acknowledges and agrees that:

  • Refunds are not available once work has begun.
  • Refunds are not available after any hours have been worked, regardless of project outcome.
  • Refunds are not available if the client changes their mind, cancels the project, or decides not to proceed with construction.
  • Refunds are not available because the service provided is the drafting work itself, which is completed and delivered as agreed.
  • The drafting service fee is for time spent, not for the success, approval, or construction of the project.
  • The client approves the quote before work begins, confirming full understanding of the billing structure.

This policy is firm, final, and legally enforceable.

10. Payment Terms

10.1 Invoicing

Invoices are issued at project completion or at agreed milestones.

10.2 Payment Deadline

Payment must be made in full within 15 days of the invoice date, using the bank details provided on the invoice.

10.3 Late Payments

If payment is not received within 15 days:

  • Work may be paused or suspended.
  • Additional projects may not commence until outstanding balances are cleared.
  • We reserve the right to apply reasonable administrative fees for significantly overdue accounts.

11. Intellectual Property

All drawings, documents, and digital files remain the intellectual property of SCH CAD Drafting Services until full payment is received.

Upon full payment:

  • The client is granted a non-exclusive license to use the drawings for the specific project they were created for.
  • Drawings may not be reused, resold, or redistributed without written permission.
  • We retain the right to store, archive, and reference the work for internal purposes.

12. Privacy

We handle personal information and project files in accordance with our Privacy Policy, including:

  • Name
  • Company details
  • Email address
  • Documentation and project files

We take reasonable steps to protect your information and do not sell or trade personal data.

13. Third-Party Services

We may use third-party platforms (e.g., cloud storage, email services) to deliver our work. We are not responsible for outages, errors, or issues caused by external providers.

14. Changes to These Terms

SCH CAD Drafting Services may update these Terms at any time. The most recent version will always be available on this page. Continued use of our services constitutes acceptance of any updated Terms.
